Drink driving: St James' Interchange motorist jailed for five months and handed nine-year ban

A serial drink driver has been jailed and banned from the roads for nine years after driving through the streets of Paisley while drunk and disqualified.

Stephen Kerr was hit with a five-month jail sentence as well as being told he must not get behind the wheel for almost a decade after admitting his latest offences.

At Paisley Sheriff Court, Kerr, 31, pleaded guilty to failing to provide a sample and driving while disqualified on Sunday night.

The court heard that he had five previous convictions for driving while disqualified and six for failing to provide a sample.

Kerr will also be forced to take his driving test at the end of this ban period.

Cops spotted Kerr driving suspiciously and pulled him over at 9.15pm on Sunday near the St James Interchange in Paisley

When Kerr was brought up from custody to hear the charges against him, he looked on impassively.

Depute fiscal Maureen McGovern told the court: “The attention of police officers was drawn to a vehicle because of the manner it was being driven in.

“When the officers stopped the car they found they could smell alcohol off the driver, who identified himself as Mr Kerr.

“Mr Kerr told the officers he was disqualified. He was slurring his words and police officers asked him to provide a sample of breath.

“He was unsteady on his feet and and continued slurring his words.”

Kerr refused to comply and was taken to a local police station where he again refused to provide any kind of sample.

He was arrested and made no reply when cautioned and charged.

Kerr’s defence agent said: “My client pleaded guilty at the earliest possible opportunity. He is in a relationship and has two children.

“And he claims Jobseekers Allowance.”

The court heard that Kerr, of Dennistoun in Glasgow, had a number of previous convictions which left Sheriff Susan Sinclair with no alternative but to hand down a jail term and lengthy ban.

She told Kerr: “I simply have no alternative but to hand you a custodial sentence.

“You have been convicted a number of times on analogous matters and have clearly not learnt your lesson.

“I will impose a driving ban of nine years and order you to re-sit your test when the time may come.

“You will have forgotten how to drive by then, if you ever knew.”
